Update on Docks Regulations Review

Having considered the views of those who made submissions to the Authority based on our Regulatory Impact Analysis and taking into account that we will be revoking specific legislation pertaining to the Docks, the Board of the HSA have given approval to proceed with a Code of Practice which will give practical guidance in relation to the hazards in the docking industry and have a positive impact on health and safety within the industry.

Regulatory Impact Analysis

The Health and Safety Authority reviewed the Docks (Safety, Health and Welfare) Regulations 1960 (S.I. No. 279 of 1960) to determine the future approach to legislation and guidance material relating to safety, health and welfare in dock work.  The primary objective of this review was to ensure an up-to-date and comprehensive legislative basis for applying necessary safety, health and welfare at work requirements in the docking industry.

A Regulatory Impact Analysis (RIA) was prepared as part of the review.  The RIA examined the available options and their potential impacts on key stake holders.  The preferred option identified in the RIA was that of revoking the Docks Regulations 1960 and relevant elements of the Safety in Industry Acts 1955 and 1980 and publishing a guidance document or a Code of Practice to address specific  docking hazards which are within the Health and Safety Authority’s administration and enforcement remit.

In accordance with the Authority’s standard public consultation processes, a Regulatory Impact Analysis was published on the Authority’s website on 12th January 2010, seeking submissions, with a closing date of 12th February 2010.
