FVG Construction & Maintenance Limited fined €50,000 following death of worker

Judge Rory McCabe, on Wednesday 8th of December in Galway’s Circuit Court, fined FVG Construction & Maintenance Limited €25,000 on each of two counts amounting to a total of €50,000 plus costs. 

Judge Rory McCabe, on Wednesday 8th of December in Galway’s Circuit Court, fined FVG Construction & Maintenance Limited €25,000 on each of two counts amounting to a total of €50,000 plus costs. 

The company pleaded guilty to Section: (1) Regulation 25 (b) of the Safety Health and Welfare at Work (Construction) Regulations 2013 – the employee did not have a Construction Skills Certification Scheme card for operating a site dumper on a construction site.

The company also pleaded guilty to Section 8 (2)( c) (iii) of the Safety, Health and Welfare at Work Act 2005 – the company did not ensure the maintenance of plant and machinery that was safe and without risk to health.

Mark Cullen, Chief Inspector with the Health and Safety Authority said, “Companies should ensure all employees have the appropriate information, instruction and training to operate plant and equipment and that all plant and equipment being used on a construction site is regularly maintained and safe to use”.
